Terms and Conditions

The following terminology applies to these Terms and Conditions, Privacy Statement, and Disclaimer Notice, as well as any or all Agreements: “You”, “Your”, "The Customer", "The Client" refer to you, the person accessing this website, and/or booking and accepting Oahu Picnic Retreats LLP’s Terms and Conditions. “The Company,” “Ourselves,” “We,” and “Us” refer to our company, Oahu Picnic Retreats LLP. “Party,” “Parties,” or “Us” refer to both the Client and ourselves, or either the Client or ourselves. Any use of the above terminology or other words in the singular, plural, capitalization, and/or he/she or they, are considered interchangeable and therefore refer to the same.

By using this website, You are deemed to have read and agreed to the following Terms and Conditions, which may be updated or changed from time to time by Oahu Picnic Retreats LLP without notice to You. If You do not agree with any of the Terms and Conditions, do not use this website, our mobile app, or our services. Because our services are evolving over time, We may change or discontinue all or any part of our services, at any time and without notice, at our sole discretion. Your continued use of this website following the posting of any changes to these Terms and Conditions constitutes acceptance of those changes.

1 / Location

We cannot guarantee specific locations since all sites operate on a first-come, first-served basis (unless booking with a permit or a private residence). To ensure the best experience, we may relocate your picnic at our discretion. Common reasons for relocation include safety, privacy concerns (as we cannot control who will be in a public space and when), access to shade, and optimal views.

While we strive to secure the desired location, we cannot guarantee it. If the chosen spot is unavailable, we will set up in a nearby suitable location. Please note that we cannot guarantee privacy, as these are public spaces. All local rules, signs, laws, and regulations apply. Specifically, some parks and public areas in Hawaii have rules against glass bottles and alcohol, so be sure to check ahead of time. If you decide to bring your own alcoholic beverage, we are not responsible for any fines/tickets issued to you.

Locations requested outside of a 15-mile radius of Kailua will require a $30 travel fee.

2/ Accessibility

The locations we use are generally considered safe at the time of booking, but each has its own risks and accessibility challenges—please remember these are public spaces beyond our control. We cannot manage terrain, public use, weather, and other factors. If you need assistance reaching a picnic location or require specific equipment (such as tables and chairs versus pillow seating), please inform us before booking. Be aware that many locations may have difficult terrain, including steep inclines, steps, grass, uneven pathways, sand, rocks, and other barriers. Natural processes like wind, rain, and wave activity frequently alter locations, so we cannot guarantee access.

3/ Use of Equipment

All Equipment supplied on hire is the property of Oahu Picnic Retreats.

Any damage, loss or extensive cleaning will result in a fee to The Customer.

You/The Client who paid for the event is responsible for any loss, damage, or stains to items such as plates, goblets, bowls, vases, props, pillows, blankets and other decorations. We kindly ask that you notify us immediately (preferably with a photo of the damage/stain)if any items are lost, damaged, or stained. We provide stain remover in the basket just in case. If the item can be saved, you will not be charged. If the item is permanently damaged, we'll work with you to assess the damage and provide an itemized list of replacement costs, which will be billed to you separately. Replacement fees are payable within seven days unless otherwise agreed.

The Customer is liable for any damage or loss of equipment during the rental period, regardless of cause. This includes, but is not limited to:

• Improper use of equipment

• Disappearance of equipment

• Damage or loss from unknown causes

• Cigarette burns on any furniture or décor items (smoking is not permitted on or near the property of Oahu Picnic Retreats LLP)

• Red wine or other staining product spillages on any furniture or décor items

Additionally, with the exception of battery-powered candles and our Luxe S'mores Experience, no candles, fires, or other flammable items are permitted during the booking.

4/ Food

Please inform us of any food sensitivities before booking. We strive to minimize cross-contamination with potential allergens. Additionally, we handle dairy, beef, pork, turkey, chicken, nuts (peanuts, tree nuts, coconut), alliums, and soy.

We are not responsible for any food allergies, issues, or illnesses caused by foods consumed or purchased from third-party vendors. By booking with us, you acknowledge and accept that Oahu Picnic Retreats LLP and our third-party vendors are not liable for any adverse reactions or health issues related to food.

5/ PAYMENT

A 50% deposit is required at the time of booking. The remaining balance is due at least 5 days before your picnic experience. The event setup will not occur without full payment.

6/ CANCELLATION, CREDIT + REFUND POLICY:

We understand that plans can change! Here’s how our cancellation and rescheduling policy works:

For our Oahu Essential Elegance and Hawaiian Luxury Experience Picnics:

Full Refund:

Available for cancellations with a two-month notice.

Rescheduling for Credit:

We do not offer refunds within two months of your reserved date but will try to reschedule your picnic or issue a credit with sufficient advance notice.
You have up to 6 months to reschedule and use your credit.

Full Credit:

Provided for rescheduling within 2 months, up to 72 hours in advance.

Partial Credit (50%):

Available for cancellations between 72 and 24 hours before your appointment.

No Credit:

No credits can be offered for cancellations within 24 hours or for no-shows.

For Proposals, Elopements, and Groups of 10 or more:

Being that each proposal, elopement and group event will have unique elements of its own, these events will have special contracts with terms and conditions that cater to specific needs. For example, if your elopement or proposal requires a specific band or private chef - we will need to write the refund/cancellation policies to cater to our vendors as well.

Reason for Policy:

This is because we work with vendors - ordering food, flowers, etc. to prepare for your celebration. We also turn down other bookings to ensure our team can focus on making your experience unforgettable.

We are committed to providing the best possible service and appreciate your cooperation.

7/ Weather

All reservations are weather permitting (Rain or wind). We keep a close eye on the forecast and will contact you 48 and 24 hours in advance if there's a weather event to discuss your options. Either find a different location (Different side of the island, or indoor location) or reschedule for a different day or time. Oahu Picnic Retreats LLP defines a “weather event” as a 30% or greater chance of rain, and/or +25mph wind gust at the picnic location and time, up to 30 minutes before or after, as determined by Hawaii Weather Now and Accuweather.

If the CLIENT prefers to reschedule, a full credit will be provided. If the CLIENT requests to reschedule with a low chance of rain (29% or less), Oahu Picnic Retreats LLP may issue a reduced credit to cover the cost of food and flowers.

In the case that the CLIENT's picnic event can't be rescheduled and must be canceled, we'll refund the full cost of your picnic (minus the cost of food, florals, and a small labor fee) and deliver your food/florals/etc.

8/ Force Majeure

If Oahu Picnic Retreats LLP is unable to fulfill its obligations, either wholly or partially, due to circumstances beyond its control (including but not limited to acts of God, inclement weather, strikes, lockouts, bushfires, fires, floods, traffic accidents, riots, pandemics, civil unrest, government actions, interference by civil or military authorities, terrorist attacks, or acts of war). During the period affected by the force majeure, our obligations under these Terms will be suspended to the extent they are impacted. Oahu Picnic Retreats LLP will not be liable for any loss or damage suffered by the Client due to delays caused by such force majeure events, nor for any loss or damage if the Client cancels or postpones due to a force majeure event.

9/ Liability

Oahu Picnic Retreats LLP shall not be held responsible or liable for any damage, injury, illness, death, or loss of income sustained by the client, any third parties, or properties resulting from the hire of equipment or provided services. All hired equipment is the responsibility of the client until it is returned to Oahu Picnic Retreats LLP.

10/ Image and Video Release

By booking with Oahu Picnic Retreats LLP, you grant us permission to post photos and videos taken by our team or shared by you on our social media accounts and to use them in any future promotional materials. All photos and videos taken by our team or provided by you are the sole property of Oahu Picnic Retreats LLP and may be used at our discretion.

In addition, if you share photographs or videos of your picnic package on social media or with us, Oahu Picnic Retreats LLP reserves the right to use such content in its promotional materials.

Additional Legal Points:

• Usage Rights: By granting permission for photo and video use, you acknowledge that Oahu Picnic Retreats LLP has the right to edit, alter, copy, exhibit, publish, or distribute these photos and videos for any lawful purpose.

• No Compensation: You understand and agree that you will not receive any compensation, royalties, or other payments for the use of your photos and videos.

• Withdrawal of Consent: If you wish to withdraw your consent for the use of specific photos or videos, you must notify Oahu Picnic Retreats LLP in writing. However, previously published materials cannot be retracted.

• Third-Party Rights: You confirm that any individuals appearing in the photos or videos have given their consent to be photographed or recorded and for the content to be used as described.

• Liability: Oahu Picnic Retreats LLP is not liable for any claims, demands, or causes of action arising from the use of these photos and videos.

By proceeding with our services, you acknowledge that you have read, understood, and agreed to these terms.
